That means paternity has been established as a matter of law, but until a family law orders esstablishes an order (or this could be stipulated to by the parties but you&#039;d want it ratified by the court), the mother is still the natural legal custodian of the child and the father has no legal rights in terms of visitation (not called timesharing) or any decision making. 		<description>I was recently at hearing with my brother where the attorney filed to establish paternity because the child was born out of wedlock but he was present at birth and his name is on the birth cerificate.

The defendant&#039;s  attorney filed to dismiss saying that paternity was already establised because the father was on the birth certificate.  Reading this article it sure sounds like my brother&#039;s attorney was doing te right thing.  The Judge did not dismiss but there will be another hearing.

Please advise.  Thank you.</description>
